Who is responsible for traffic violations in a company vehicle

Uzbekistan has clarified how administrative liability is applied for traffic violations recorded by cameras on company vehicles.

Depending on the situation, liability may be assigned either to the person responsible for the operation of the vehicle or to the employee to whom the vehicle was lawfully transferred.

According to Article 17¹ of the Code of the Republic of Uzbekistan on Administrative Responsibility, if a violation is recorded by automated means on a vehicle owned by a legal entity, the person responsible for the operation of the vehicle or the person who used it lawfully under civil law relations shall be held liable.

When considering a case, account is taken of who was appointed responsible for the operation of the vehicle and to whom the vehicle was transferred in the prescribed manner.

A separate procedure applies to the assessment of penalty points. Starting April 1, 2026, they will also be assessed for certain traffic violations detected by automated photo and video recording equipment.

At the same time, administrative fines and penalty points are different measures of liability. To assess points, the identity of the driver must be established, according to the explanation from the Road Traffic Safety Department (RTSD).

The procedure for identifying the driver of a company vehicle is defined by the Regulation approved by Cabinet of Ministers Resolution No. 296 of May 6, 2025.

In accordance with paragraph 5² of the document, a legal entity must open a personal electronic account in the relevant information system. Driver details must be entered before the vehicle is handed over, and the employee receiving the vehicle must confirm this data.

If information about the actual driver is missing or not confirmed in the prescribed manner, the rules provided for by the Regulation for determining the person to whom penalty points are assessed shall apply.

The RTSD also reminded heads of organizations that an internal order assigning a vehicle to a specific employee is not sufficient.

To identify the driver, the established electronic procedure must be followed.
