According to the information service of the Bukhara regional department of the Bureau of Compulsory Enforcement to "Xabar.uz", in the city of Bukhara, J.Kh., who faced opposition from her spouse R.Yu. due to family disputes, was unable to take her two-year-old daughter with her.
According to Ikhtiyor Olimov, the head of the department's information service, during the past period of this year, enforcement actions were carried out on 666 enforcement documents regarding the recovery of a child or visitation with a child, which were in the Bureau's proceedings. Of these, 250 have been completed, and 189 have been practically executed.
It was revealed that J.Kh., a resident of the city of Bukhara, left the home of her spouse R.Yu. due to a family dispute. However, despite all her efforts, the woman faced strong opposition from her husband and was unable to take her 2-year-old daughter with her. Following this, the woman applied to the Bukhara inter-district civil court with the aim of taking her child into her custody.
The court studied the circumstances of the case, satisfied the claim, and issued a ruling to take measures to ensure the enforcement of transferring the 2-year-old girl to the custody of her mother, J.Kh. Once this enforcement document was received by the Bukhara city department of the Bureau, enforcement actions were initiated immediately.
The debtor father was familiarized with the court documents and warned about the necessity of voluntary compliance. However, he refused to comply with the requirements of the court document and stated that he would not give up his child.
During the enforcement actions, it was established that the girl was being raised in one of the private preschool educational institutions in the city of Bukhara. With the participation of the institution's officials and the parties, enforcement actions were carried out in accordance with the established procedure, and the 2-year-old girl was safely returned to her mother's custody.
In executing enforcement documents regarding such cases, primary attention is paid, first of all, to ensuring the rights and legal interests of the child.
