The return of money recovered in criminal cases will be accelerated

In accordance with the presidential decree, additional mechanisms are being established to ensure the timely execution of court documents on the return of bail monies deposited in criminal cases and funds collected in favor of the budget to compensate for the damage caused, as well as compensation for material and moral damage caused to a rehabilitated person. The return (payment) of money is subject to a penalty in favor of a citizen or entrepreneur for each day of delay.

Uzbekistan will strengthen mechanisms for protecting the rights of individuals and business entities in criminal proceedings. A number of tasks were set in this regard in a decree signed by President Shavkat Mirziyoyev on August 27 following an open dialogue with entrepreneurs.

In particular, the procedure for returning bail amounts deposited in criminal cases will be simplified. Also, if it is determined that the funds collected in favor of the State Budget for compensation for damage will be returned to a citizen or entrepreneur based on a court decision, these funds will be returned to the citizen or entrepreneur from the State Budget funds by the Ministry of Economy and Finance.

Material and moral damage caused to rehabilitated persons will be compensated by the Ministry of Economy and Finance based on a court decision from the funds of the Republican Trust Fund for Compensation of Property Damage to Individuals and Legal Entities.

If the court's legally binding decision on the return of funds collected for compensation for damage and compensation for material and moral damage caused to rehabilitated persons is not executed within 10 working days from the date of submission, interest (penalty) shall be calculated on the unfulfilled portion of the obligation in the amount of the base rate of the Central Bank.
