Uzbekistan plans to introduce an electronic risk assessment system for businesses
In Uzbekistan, it has been proposed to launch an electronic system called "Risk Analysis," which will automatically determine the likelihood of legislative violations in the activities of entrepreneurs. The results obtained are intended to be used for preventing violations and planning control measures.
The draft regulation on the procedure for introducing the system was prepared by the Drug and Firearms Control Agency under the Presidential Administration. The document has been published on the portal for public discussion of draft regulatory legal acts. The discussion will last until October 11.
According to the draft, the system will automatically establish the risk level based on approved criteria without human intervention. For the analysis, it is planned to use information obtained through interagency electronic interaction, including data on licenses and permits, statistical information, verified appeals from citizens and legal entities, information from the media and open sources, as well as the results of control measures by other state bodies, including mystery shopping.
During the analysis, no documents or information can be requested from entrepreneurs. The assessment process itself must not suspend or hinder business operations. At the same time, the system will not assess entrepreneurs who do not fall under the agency's competence.
The risk level determined by the system cannot serve as a basis for a fine or suspension of a license. It will be used solely for preventing violations and planning inspections.
Based on the assessment results, entrepreneurs will be divided into three categories: high risk — from 81 to 100 points, medium — from 61 to 80 points, and low — less than 61 points.
Inspections of low-risk entrepreneurs will not be conducted, except in emergency cases provided for by law.
Separate criteria are provided for entrepreneurs working with narcotic drugs, psychotropic and potent substances, as well as precursors.
In addition, the absence of a license and a certificate of compliance with national good practice requirements for pharmacies, wholesale warehouses, and manufacturers, the absence of a medical license for non-state medical organizations, violations during the import, export, and transit of substances, operating at addresses not specified in the license, as well as the sale of unregistered substances will be taken into account.
Separate indicators are also established for the transportation of these substances by road, rail, and air transport. In particular, it is proposed to assign 35 points for insecurely closed or damaged packaging, 25 points for transportation without the mandatory accompaniment of a responsible person, and 20 points for the absence of an approved consignment note.
Entrepreneurs who disagree with the analysis results will be able to appeal them to a higher authority or in court.
If the document is adopted, it will come into force three months after its official publication.
