In Uzbekistan, it is proposed to divorce spouses without a reconciliation period

The government has prepared a draft law aimed at improving the regulation of family relations. The document contains a proposal not to establish a reconciliation period during the dissolution of marriage if one of certain grounds is present.

"It is proposed to define cases where one of the spouses has been subjected to violence or pressure, has become addicted to alcohol or narcotic substances, has contracted HIV, as well as if the spouses have not lived together without valid reasons continuously for three years, as grounds for the dissolution of marriage without providing a reconciliation period."

Article 40 of the Family Code establishes the procedure for the dissolution of marriage through court. In this case, the court may postpone the consideration of the case and grant the spouses a reconciliation period of up to six months. If the new law comes into force, this article may be amended.

At the meeting, Dilnoza Kattakhonova emphasized that the "mahalla seven" must strengthen measures to eliminate factors leading to divorce. According to the analysis, in more than 60% of applications to the courts, the intention to divorce was indicated without justified reasons, such as incompatibility of characters, mutual distrust, or unreadiness for family life.

The government representative reported that now women on the verge of divorce will be worked with individually. Through a special program, not only the woman but also every member of her family will be covered. They will be helped to find a solution to their problem. For example, if the divorce is related to the man's lack of work, that is, economic difficulties in the family, the khokim's assistant will take measures to ensure the husband's employment. In turn, work will be organized to cover the family's children with educational services.

"If the reason for divorce is related to employment, housing, health, psychological or legal problems, providing the family with appropriate services simultaneously and comprehensively has been defined as a task."

As reported, today there are more than 10.5 million families in Uzbekistan. In January-July of this year, 115,879 new marriages were registered in the country. During this period, 29,353 divorce cases were recorded. Divorces increased by 1,470 cases (5%) compared to the same period in 2025.

"While in January the growth rate of divorces was 11%, by July we observe its decline to 5%. However, in Jizzakh, Samarkand, and Surxondaryo regions, divorces are growing. In Namangan and Andijan regions, a decrease is noted."
