Constitutional Court meetings will be broadcast on the internet

The Constitutional Court has been tasked with the obligation to broadcast its meetings on the internet. According to the new version of the law on the Constitutional Court, signed by President Shavkat Mirziyoyev on October 14, the relevant norms will come into force on January 1, 2028.

Constitutional Court sessions to be broadcast over the internet

The Constitutional Court (CC) will implement an information system that enables citizens and companies to apply online, as well as to participate in the proceedings via video-conferencing and a mobile application. In addition, the authority is required to broadcast its sessions on the internet. According to the new edition of the Law on the Constitutional Court signed by President Shavkat Mirziyoyev on October 14, the relevant provisions will come into force on January 1, 2028.

Thus, more than a year has been allocated to create and launch an electronic system that will allow court proceedings to be conducted fully online. Other rules established in the law will apply immediately upon its publication, that is, from October 14.

Henceforth, proceedings in the Constitutional Court can be conducted in electronic form alongside written form, and such documents will have equal legal force.

If claims do not fall within the jurisdiction of the Constitutional Court, the CC has the right to forward the applications to other bodies or refuse to consider them. A maximum of 15 days is allocated for the preliminary examination of applications received from individuals and organizations.

The new edition of the law solidifies the procedure for preparing cases for consideration — from identifying the participants in the process to involving specialists and experts. Preparatory work must not exceed 20 days from the moment the court receives the application. After that, the authority must make a decision within 10 days on scheduling the hearing and notify all interested citizens at least 5 days before the start of the hearing. Information about the date, place, and time of the meeting must be published on the official website of the CC.

The law sets the deadline for sending decisions of the CC to the parties at 5 days from the time of their adoption.

If a case is being considered on the basis of a request from the Supreme Court requiring clarification regarding the conformity with the Constitution of a normative legal act applied in any other proceeding, judicial proceedings are suspended until the decision of the CC is issued. In such a case, a period of one month is given to issue a decision.

In addition, the CC undertakes the obligation to annually prepare a report on the state of constitutional legality, based on the practice of cases considered during the specified period. The report must be sent to the President of the Republic, as well as to both chambers of the Oliy Majlis of the country.
