Renovation in Uzbekistan: Is it possible to demand premium-class housing in exchange for the one being expropriated?
Tashkent, Uzbekistan – Podrobno.uz News Agency.
During the renovation process, property owners often seek the most favorable compensation terms. One frequently asked question is whether the owner has the right to refuse the offered housing and insist on a premium-class apartment. Let's consider the legislation on this matter.
First of all, the law focuses not on the desired housing category, but on the principle of fair compensation for the value of the expropriated property and the scope of property rights. Therefore, the requirement to provide a premium-class apartment is not mandatory in itself.
However, this does not mean that the characteristics of the previous housing are not taken into account. If the expropriated apartment itself is considered premium—for example, it has a high market value, is located in a prestigious area, is of a large size, and has high-quality finishes—all these factors must be taken into account when calculating compensation. In other situations, obtaining a premium apartment is only possible by mutual agreement of the parties. For example, the owner may pay an additional fee to cover the difference in price, or this option may be discussed in a separate agreement.
Thus, during renovation, what is guaranteed is not housing of a specific class, but rather fair compensation commensurate with the value of the expropriated property and the owner's rights.
As a reminder, Podrobno.uz previously examined the possibility of demanding housing abroad instead of compensation during renovation, as well as cases in which the owner is entitled to additional compensation if the new apartment is cheaper than the previous one.
