Renovation in Uzbekistan: Is it possible to demand housing abroad instead of compensation?

During renovation, the owner of expropriated property can expect various types of compensation. However, the question arises: does he/she have the right to demand property located in another country? Let's look at the available compensation options and the decisions that remain with the owner.

The request for housing abroad is not a legal compensation mechanism during renovation. Typically, the owner is offered equivalent housing in Uzbekistan, monetary compensation, or another option consistent with the terms of the specific project and legislation.

The key principle is to protect the owner's right to fair compensation for their property. Compensation must correspond to the market value of the expropriated property.

If the owner chooses monetary compensation, they independently decide how to use the funds received. They can subsequently purchase property either in Uzbekistan or abroad. However, this is a personal decision for the owner and is not part of the obligations under the renovation project. In other words, after receiving compensation, a person is free to use the funds as they see fit, but the renovation organizer is not obligated to select or purchase housing abroad.

This is because purchasing real estate in another country involves additional issues: compliance with foreign law, paperwork, property registration, tax obligations, and foreign exchange procedures. Such actions are beyond the authority of renovation project organizers.

Therefore, the requirement to provide an apartment or house outside of Uzbekistan is not included in the compensation options provided by law. However, the owner has the right to receive full and fair compensation for their property.

To prevent disputes, it is recommended to formalize all compensation terms in advance—whether a new apartment, a cash payment, or another option—in a written agreement.
