On September 4, the Cabinet of Ministers of Uzbekistan approved the procedure for financially incentivizing citizens and organizations that report violations of licensing and permitting requirements.
For a confirmed report, the applicant will be paid 10 percent of the fine imposed on the violator.
The new mechanism applies to reports about individuals and legal entities failing to comply with the requirements established when licenses and permits are issued, as well as requirements set when sending a notification on starting an activity. The government expects this system to serve the development of public control.
Violations can be reported through the "License" electronic system or the mobile application of the Ministry of Justice. When submitting an application, passport details — PINFL or TIN, contact phone number, and bank card or account number must be provided.
Unedited photo or video materials confirming the violation must also be attached to the report. They must show the date and time of filming. The duration of the video recording must not exceed 120 seconds.
If an investigation is already being conducted on the specified case or if the provided information is not confirmed, the application will not be considered. The application can also be rejected if the company possesses a license, permit, or notification that allows it to perform the actions indicated in the report.
The authorized body must notify the applicant of the rejection decision within three working days. If the application is accepted for consideration, the investigation must be conducted within a period of up to 10 working days.
If the violation is confirmed, the authorized body makes a decision to impose a fine and sends a notification to the applicant via SMS or through the "License" system. After the fine is paid, the applicant can receive 10 percent of it.
The payment must be transferred to the specified bank card or account within one working day after the fine is paid.
The Ministry of Economy and Finance and the Ministry of Digital Technologies have been instructed to set up the mechanism for making payments to applicants in the Single Billing System and treasury systems within one month. The Ministry of Justice must launch the function for reporting violations within two months.
The new procedure will come into force on December 8 — three months after the publication of the decision.
The decision was adopted against the backdrop of President Shavkat Mirziyoyev's instruction to halve all types of financial sanctions for businesses.
During an open dialogue with entrepreneurs on August 18, the head of state emphasized that fines should be applied "for order, discipline, and prevention in the sector."
