Fines may be introduced for failure to report an offense
In Uzbekistan, it is proposed to introduce new administrative liability for employees and officials of state bodies and other organizations who are tasked with the obligation to report cases of offenses. A draft law has been developed to introduce amendments to the Code of Administrative Responsibility in this regard.
Fines may be established for failure to report an offense
The draft notes that current legislation does not provide for separate administrative liability for the failure of officials and employees of state bodies or other organizations to report offenses.
According to the authors of the draft, in some cases, this leads to the concealment of offenses or the failure to take necessary measures in a timely manner.
For this reason, it is proposed to supplement the Code of Administrative Responsibility with a new Article 188⁵ — "Violation of legislation on reporting cases of offenses."
According to it, if an employee or official of a state body or other organization, who is tasked with the obligation to report an offense, fails to report it to the internal affairs bodies and the "Inson" social services centers in accordance with the established procedure, an administrative fine may be applied.
It is proposed to impose a fine of:
- 3 to 5 BCAs (Base Calculating Amount) on citizens and employees;
- 5 to 10 BCAs on officials.
If the same offense is committed repeatedly within one year after the application of an administrative penalty, the punishment will be tightened.
In this case, the fine is envisaged to be set from 5 to 10 BCAs for citizens and employees, and from 10 to 15 BCAs for officials.
The draft notes that these amendments are aimed at increasing the efficiency of timely detection and prevention of offenses, and strengthening the responsibility of employees of state bodies and organizations.
It is also expected that the new procedure will serve to strengthen the system of reliable protection of the rights of citizens, especially women and minors.
If the law is adopted, it will enter into force from the day of its official publication.
