After appealing to the Ombudsman, a convict's assessment of his rehabilitation was reviewed
After the lawyer's appeal to the Ombudsman, the conclusion that the convicted individual K.B. had not embarked on the path of correction was revised. It was revealed that during its preparation, a portion of the compensated damage and previously announced incentives were not taken into account. K.B. was serving his sentence in colony No. 13. After the lawyer's appeal to the Ombudsman, the conclusion that the convicted individual K.B. had not set out on the path of correction was revised. It was established that during its preparation, a portion of the compensated damage and previously announced incentives were not taken into account.
K.B. was serving his sentence in colony No. 13. His lawyer reported that the convict had compensated a significant portion of the material damage, had no disciplinary sanctions, and had received incentives.
Staff members of the Ombudsman's office studied the conclusion and identified discrepancies in the data regarding the amount of damage and the compensated sum. In addition, the incentives previously announced to the convict were also not taken into account.
Following this, the Ombudsman submitted a representation to the Department of Execution of Punishments under the Ministry of Internal Affairs. An internal investigation was conducted into these facts, the results of which led to a decision to consider the issue of disciplinary liability for the responsible employees.
Subsequently, K.B.'s status was re-examined by the commission with the participation of all its members. Based on the results, he was issued a conclusion stating that he had set out on the path of correction.
Later, the materials were reviewed by a court. K.B.'s remaining term of imprisonment was replaced with another, milder punishment in accordance with Article 74 of the Criminal Code.
Following this, the convict was released from the correctional institution.
