After the sentencing of minor D.T., who hit a YPX inspector with a BMW in Tashkent and caused his death, to 2 years and 4 months of deprivation of liberty caused various discussions on social networks, the Tashkent city courts provided additional explanation in this regard.
It is emphasized that the main purpose of punishment is the moral correction and education of persons who committed a crime unknowingly. That is, the purpose of punishment is by no means revenge or torture, but rather returning the person who committed the crime to society as a healthy member.
The legislation separately regulates the issues of judicial consideration and sentencing of criminal cases committed by minors. In particular, these include the consideration of criminal cases involving minors in closed court hearings, and the imposition of deprivation of liberty in accordance with Article 85 of the Criminal Code. It is also specifically noted in the legislation that the imposed sentence is served not in general colonies, but in separate educational colonies.
According to the report, these norms in the legislation are not without reason. Because minors are not yet fully formed mentally, physiologically, and socially, the noted legal procedures once again show that the purpose of punishment is rehabilitation.
"True, the deceased cannot be brought back to life. From this point of view, the passionate reactions of the public are viewed with understanding. However, it should not be overlooked that the court reaches a conclusion with composure and a deep analysis of every circumstance of the criminal case. From this point of view, in sentencing the minor Turg‘unov, relying on the above legal norms, it seems that factors such as him being a school student, not yet having reached the age of 16 at the time the crime was committed, and most importantly, moral correction, rehabilitation, and prevention of new crimes were also taken into account. Because the system of punishment for minors in criminal law is based on the principles of humanism," the official explanation says.
At the same time, it was announced that the verdict has not yet entered into legal force, that the right of the parties to appeal against it is guaranteed by law, and if an appeal is received from the parties against the verdict, it will be reviewed in the higher court instance in accordance with the established procedure and given a legal assessment.
