New rules for promotional SMS and calls introduced in Uzbekistan

Starting November 1, new rules for sending promotional SMS messages and making promotional calls will come into force in Uzbekistan. Companies and mobile operators will only be able to send promotional messages to subscribers with the users' prior consent.

Consent to receive advertising must be executed in written or electronic form. This requirement applies to organizations and individuals using mobile communications for promotional mailings.

The new regulations also introduce time restrictions on promotional contacts. Making promotional calls and sending promotional SMS via mobile networks will be prohibited from 6:00 PM to 9:00 AM.

Subscribers will be able to decide for themselves whether they want to receive such messages and calls. To opt out of promotional contacts, users can contact their telecom operator with a request to place a block.

It will be possible to restrict the receipt of advertising fully or partially.

The changes also affect companies engaged in mass promotional mailings. For such activities, they will need to register the systems used in a special state register for personal data processing.

The new requirements are designed to regulate promotional contacts via mobile communications and to protect subscribers from unwanted messages and calls.

Companies will have to take into account the expressed will of users and comply with the time restrictions established by law.

Liability measures are provided for violating the new requirements. Such cases will be treated as non-compliance with legislation in the field of advertising and personal data protection.

The document also provides for other changes in the operation of state information systems.

In particular, starting October 1, 2026, when citizens' personal data changes, the information must be automatically updated in all relevant state databases via the interdepartmental data exchange system.
