Illegally constructed buildings can only be demolished by court order - Ministry of Construction
If illegally constructed buildings do not meet the relevant requirements, the issue of their demolition will be resolved only through court proceedings, Javohir Ergashboyev, a representative of the Ministry of Construction and Housing and Communal Services, told Kun.uz.
According to the Ministry of Construction, illegally constructed structures can only be demolished based on a court decision.
According to a ministry representative, if the government declares an amnesty and the object is included in the relevant register, the building will first undergo an instrumental and technical inspection. This inspection will determine whether the object meets the established requirements and whether it can be strengthened. If the building meets the technical requirements and the necessary deficiencies are eliminated, it can be accepted for use. After that, a state act is issued and ownership is recognized. The ministry representative noted that the authority to demolish buildings that do not meet the requirements is not directly granted to any state body.
Javohir Ergashbayev said: "If the building does not meet any requirements or is an object whose construction has been suspended for other reasons, no body has the authority to demolish it directly. This can only be done through a court order."
**Escrow system reduces the risk of paying for unfinished houses**
A representative of the Ministry of Construction also provided information about the new escrow system during the interview.
He noted that the main purpose of the system is to protect the funds paid by citizens for houses under construction and reduce the risk of non-fulfillment of obligations by the builder.
According to the new regulation, after the design work on the object is completed, a certain part of the funds required to start construction must be deposited in a special account. The representative of the ministry said that this mechanism is intended to prevent citizens from paying money and then having problems with a house that is not completed or is not put into operation for other reasons.
"This system was created to prevent citizens from paying money and being deceived, what will happen if the building collapses - this is what he said.
He said that the process of launching the escrow system is being carried out in stages.
