Court keeps prosecutor fired by Trump in office
U.S. District Judge Stanley Bastian has ruled that President Donald Trump cannot unilaterally dismiss a federal prosecutor appointed by a district court. The court stated that Roger Rogoff, whom Trump removed from office, remains the lawful prosecutor, and the individual appointed to replace him does not possess the appropriate authority.

**Court reinstates prosecutor dismissed by Trump**
According to DW, citing Politico, the court decision was announced on Thursday, October 1. The ruling was made based on a lawsuit filed by Roger Rogoff, who had been dismissed from his post as federal prosecutor for the Western District of Washington State.
Shortly after the district court appointed Rogoff to this position, Trump dismissed him and replaced him with Charles Neal Floyd, who is loyal to him.
Judge Bastian stated that such replacements contradict the system established by the Constitution and laws. This system ensures a balance between the president's right to appoint officials and the Senate's authority to confirm nominees.
The court noted that Rogoff has legally held the position of federal prosecutor since taking the oath on July 15. It was concluded that Floyd, whom the presidential administration appointed to replace him in violation of the established procedure, does not possess the authority of this office.
Bastian also prohibited US Attorney General Todd Blanche and the Department of Justice from considering Rogoff as dismissed or suspended, and from obstructing the performance of his official duties. They must not recognize anyone other than Rogoff as the prosecutor of the district in question.
The Department of Justice stated that it would appeal the decision and request a stay of its execution while the appeal is being considered.
According to Politico, the Trump administration has repeatedly attempted to bypass the Senate confirmation process in order to appoint loyalists to high-ranking positions.
The publication notes that in cases where district judges used their authority to select another candidate for the federal prosecutor position, Trump dismissed that individual.
